SECTION 1 – OVERVIEW

This website is operated by Ace Workwear Pty Ltd (ABN 27 120 678 104), trading as Ace Workwear Pty Ltd and Work 360 (“we”, “us”, “our”). By visiting our site and/or purchasing from us, you agree to be bound by the following Terms of Service (“Terms”).

If you do not agree to these Terms, you must stop using our website immediately.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform enabling us to sell products and services to you.


SECTION 2 – ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or territory.

You must not use the site for any unlawful purpose or transmit harmful code, malware, or malicious material.


SECTION 3 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason.
Non-financial content may be transferred unencrypted across networks.
Credit card information is always encrypted.

You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service without written permission.


SECTION 4 – ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

Information on our website may not always be accurate, complete, or current.
Product colours, images, descriptions, and size charts are representations only and may vary due to screen settings, manufacturing variations, or material differences.

You acknowledge it is your responsibility to monitor changes to our site.


SECTION 5 – MODIFICATIONS TO SERVICE & PRICES

Prices may change at any time without notice.
We may modify or discontinue the Service or any part of the website without liability.


SECTION 6 – PRODUCTS & SERVICES

6.1 Product Availability

All products are subject to stock availability.
We may limit quantities or decline orders suspected of being placed by resellers.

6.2 Custom / Decorated Items

Custom, embroidered, printed, heat-pressed, or otherwise decorated garments are:

  • Non-returnable and non-refundable unless faulty under the Australian Consumer Law (ACL).
  • Non-cancellable after artwork approval or once production has begun.
  • Subject to minor variations in colour, print placement, logo scale, and thread shades, which do not constitute faults.

Digital mock-ups are provided as representations only.

6.3 Product Quality

We do not warrant that products will meet your expectations, except where required under the ACL.


SECTION 7 – ORDER ACCURACY, BILLING & ACCOUNT INFORMATION

We may decline or cancel any order.
You agree to provide accurate billing, payment, and contact information.

Fraud prevention or identity checks may be applied to high-value or suspicious orders.


SECTION 8 – SHIPPING & DELIVERY

8.1 Carriers

We deliver using:

  • Australia Post
  • StarTrack
  • Aramex
  • TNT/Fed Ex
  • Couriers Please

8.2 Dispatch Times

Dispatch varies depending on stock availability and whether items require decoration.

8.3 Delivery Timeframes

Delivery timeframes are estimates only and not guaranteed.

8.4 Authority to Leave (ATL)

ATL is applied on all orders unless signature is requested.

8.5 Risk & Title

Risk in the goods passes upon delivery (or ATL).
Title passes once full payment is received.

8.6 Incorrect Addresses

You are responsible for providing accurate delivery information.
We are not liable for delays or loss resulting from incorrect addresses.


SECTION 9 – RETURNS & REFUNDS

9.1 Change-of-Mind Returns (Non-Custom Items)

We accept change-of-mind returns within 21 business days of delivery, subject to:

  • Item being unworn, unwashed, unused, and in original condition
  • Tags and packaging intact
  • Return shipping paid by the customer
  • A restocking fee applied
  • Original shipping costs non-refundable

9.2 No Returns on Custom/Decorated Items

Custom-decorated garments cannot be returned unless faulty under the ACL.

9.3 Faulty or Incorrect Items (ACL)

If an item is faulty, damaged, or not as described, we will provide repair, replacement, or refund in accordance with the Australian Consumer Law.


SECTION 10 – CLAIMS FOR MANUFACTURER FAULTS (FOOTWEAR WARRANTY)

Some footwear products are covered by a manufacturer's 6-month warranty for manufacturing defects.

10.1 Eligibility

Before submitting a claim, ensure:

  • The item was purchased from Ace Workwear / Work 360
  • The issue occurred within 6 months of purchase
  • The issue appears to be a manufacturing defect (not wear and tear)

10.2 Submitting a Claim

Email sales@aceworkwear.com.au

with:

  • Order number
  • Description of the fault
  • Clear photos/videos (soles, stitching, branding, affected areas)

We may request additional information if required.

10.3 Assessment Process

We will:

  • Acknowledge receipt
  • Review your claim
  • Forward evidence to the manufacturer if needed
  • Advise you of the outcome

The manufacturer may require the item to be returned for physical inspection.

10.4 Outcome

If a genuine manufacturing fault is confirmed, we will provide a replacement or other remedy consistent with the ACL.

If not deemed faulty, the warranty claim will be declined.


SECTION 11 – PRODUCT INFORMATION, ADVICE & USAGE DISCLAIMER

Although we make every effort to provide accurate and up-to-date information on our website, in emails, live chat, telephone conversations, quotations, and all communication channels, we do not guarantee that all such information is free from errors, omissions, or inaccuracies.

Any information, guidance, or advice—whether written, spoken, or demonstrated—is provided in good faith based on our current knowledge. This includes product recommendations, sizing guidance, safety information, decoration advice, and technical specifications. However, such information does not constitute a warranty or guarantee of suitability.

You are responsible for independently verifying:

  • the accuracy and completeness of any information provided
  • the suitability of products for your intended use, workplace needs, or environment
  • compliance with safety, technical, or regulatory requirements
  • proper installation, application, handling, and care of products

Your usage, processing, application, and handling of products remain solely your responsibility.

All product images, videos, diagrams, and demonstrations are for illustrative purposes only. Manufacturers may update or alter products without notice, and such changes may not immediately appear on our website.

Colours shown on screen may vary due to monitor resolution, calibration, lighting conditions, device settings, and material variations.

To the fullest extent permitted by law, Ace Workwear Pty Ltd is not liable for direct, indirect, incidental, consequential, special, or punitive damages arising from reliance on any information or advice provided. Nothing in these Terms excludes your rights under the ACL.


SECTION 12 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” with no warranties or endorsements.


SECTION 13 – THIRD-PARTY LINKS

We are not responsible for content on third-party sites or transactions made with third parties.


SECTION 14 – USER COMMENTS, FEEDBACK & SUBMISSIONS

By submitting content, you grant us unrestricted rights to use it.
You agree not to submit unlawful, offensive, or infringing material.


SECTION 15 – PERSONAL INFORMATION

Your personal information is governed by our Privacy Policy.


SECTION 16 – ERRORS, INACCURACIES & OMISSIONS

We may correct errors (including pricing errors) and update or cancel orders accordingly.

Under the ACL:

  • You are entitled to a refund or replacement for major failures
  • You are entitled to repair or replacement for minor faults
  • These rights cannot be excluded

SECTION 20 – INDEMNIFICATION

You agree to indemnify Ace Workwear Pty Ltd for claims arising from your breach of these Terms.


SECTION 21 – SEVERABILITY

If any part of these Terms is unenforceable, the remainder still applies.


SECTION 22 – TERMINATION

We may terminate access to the Service for breaches.
You may stop using the site at any time.


SECTION 23 – INTELLECTUAL PROPERTY

All text, images, logos, designs, artwork, and branding are the property of Ace Workwear Pty Ltd or our licensors.
You may not reproduce or use them without written permission.


SECTION 24 – ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Ace Workwear Pty Ltd.


SECTION 25 – GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.

Continued use of the website constitutes acceptance of updated Terms.
